ST Microelectronics (ST) şirketi tarafından 2007 Aralık ayında işten çıkarılan mühendisler, açmış oldukları işe iade davasını kazandılar. Temyiz süreciyle beraber 2 yıl süren hukuk mücadelesi işçilerin lehine sonuçlandı. ST çıkardığı mühendislere, işe iadenin karşılığı olan 8 maaş tazminatı faiziyle beraber ödemeye mahkum edildi. Bir çok alanda pazarın lideri konumunda olan ST, 2007 yılında cirosu 7.2 milyar USD civarındayken, İstanbul‘da faaliyet gösteren Digital TV ve digital uydu alıcıları bölümlerini kapatarak, projelerini diğer ülkelerdeki bölümlerine devretmişti. Bunun üzerine işsiz kalan mühendisler, Elektrik Mühendisleri Odası‘nda (EMO) bir basın açıklaması düzenleyerek, uygulanan işten çıkartma politikalarını protesto etmiş, aynı zamanda bu uluslararası şirketin Fransa‘daki fabrikalarında örgütlü bulunan CGT sendikasına (Genel İş Konfederasyonu) durumlarını bildirip, dayanışma çağrısında bulunmuşlardı. EMO bu haksız işten çıkarmalara, protestolara seyirci kalmayarak, hukuki mücadelesinde mühendislerin yanında olmuştur. EMO‘nun avukatı ile yürütülen davada işten çıkarılan ST çalışanları; "Performansı ve çalışması takdir gören mühendisler, kar eden bir şirketten neden çıkarılmıştır?" sorusu üzerine gitmişlerdir. Bu sorunun cevabı 2007 yılındaki basın açıklamasında da belirtildiği gibi çok açıktır. Türkiye‘de işçilerin iş güvenceleri yok denebilecek kadar az olup, işçi çıkarmanın maliyeti ise işveren için önemsenmeyecek kadar küçüktür. Bunun farkında olan şirketler Türkiye gibi ülkeleri tercih etmekte, üstelik Teknokent, Teknopark veya serbest bölgelere yerleşerek üretim maliyetlerini daha da aşağıya çekebilmektedirler. Buna rağmen büyük ölçekli yabancı sermayeli şirketler daha fazla kar edebilmek için, iş gücünün/mühendis emeğinin daha da ucuz olduğu Hindistan veya Çin gibi ülkelere yatırımlarını kaydırmaktadırlar.  Ama şu gerçekte unutulmamalıdır. Nasıl dün Fransız işçileri Avrupa dışındaki daha ucuz emek yüzünden işsiz kalmaya zorlandılarsa, bugün de Türkiye işçileri aynı konumda bulunmaktadır. Şimdi sermayeye ucuz görünen uzak doğu işçilerinin de ilerleyen zamanlarda başlarına gelecekler bellidir. Şirketlerin daha fazla kar edebilmek amacıyla kullandıkları yöntemler, emekçilerin haklarının daha fazla gasp edilmesine yol açmaktadır. İşçilere uygulanan bu sömürüye ancak işçiler dur diyebilir. ST çalışanları, ST‘nin uyguladığı bu sömürüye sessiz kalmayarak hukuki mücadelelerini verdiler ve kazandılar. İşlerine geri dönemediler ama tüm bu süreçteki tazminatlarını alabildiler. ST‘ye karşı kazanılan bu dava, beyaz yakalıların mücadelesi için değerlendirilmesi gereken bir tecrübedir. Bu ve benzeri kazanımlar aynı sömürüye farklı farklı uygulamalarla maruz kalan beyaz yakalıların, yarın korkusu yaşamadan, huzurlu ve insanca çalışmak için birlikte verecekleri mücadelenin önünü açmaktadır. TURKEY: Another Victory of White-collar Workers
 The engineers dismissed from STMicroelectronics(ST) in December 2007, won the returning to work lawsuit. The lawsuit, lasted 2 years with the appellate time, ended up on behalf of workers. ST has been sentenced to pay the 8 salaries of workers with the interest as a compensation of the returning to work.
ST, The leader of the market in many areas, in 2007 when it had a 7.2 billion USD turnover, closed the Digital TV and Digital Satellite Receiver System departments active in Istanbul and revolved the projects to the departments of other countries. The dismissed engineers, because of this reason, by holding a press conference at EMO (The Chambers of Electrical Engineer) protested against the policy of dismissal, in addition they informed the CGT (Confédération générale du travail – General Confederation of Labour) which is a trade union in the factories of ST in France, about their situation and call CGT for solidarity.
EMO stood by the engineers during the legal struggle by not being only an observer to the protests and unfair dismissals. The ST engineers with the legal adviser of EMO focused on the question: ‘‘How can the engineers appreciated for their performance be dismissed from a well-profit company?’’ The answer of this question is obvious like mentioned at the press conference in 2007. The labour-job protection in Turkey is rare and almost does not exist and the cost of dismissal is very low for the employer. The big companies, aware of this low dismissal cost, prefer the countries like Turkey, also by settling in the free trade areas like Teknokent, Teknopart, they can reduce the production costs more. Nevertheless the foreign capital enterprises for making more profit started to shift the investments to the countries like China and India where the labor force and engineer effort cost less.
However we should not forget this reality; Just as the French workers are forced to be unemployed because of the cheaper labour force in the past, today workers in Turkey have the same situation. The workers of the far east, who are seemed to be low cost to the employers today, will have the same problems in the future. The policies implemented by the companies for making more profit causes to the extortion of the proletariat right. Only the workers can stop this exploitation executed to the workers.
ST employees did not keep silent to this exploitation of ST, strove and won the legal struggle. They could not go back to their works but could gain the compensation. The lawsuit won against ST is a good experience to interpret for the white-collar workers. White-collar workers are exposed to the same exploitation through various practices. This and these kind of gains open the way of white-collar workers who are fighting together for a life without fear of tomorrow, a peaceful and decent work environment.
